Property Law

Property law is a branch of law that regulates issues such as the ownership, use, transfer and protection of movable and immovable property.

The basic principles and main elements of property law are as follows;

1. Item Types

– Immovables: These are fixed assets such as land, apartments, apartments. The purchase and sale of immovables are carried out with the title deed registration.

– Movables: These are movable assets such as vehicles, goods, materials. The transfer of movables is usually based on the principle of possession.

2. Right of Ownership

– Ownership refers to having full and comprehensive rights to a property. The right of ownership can be used, transferred or leased by the owner of the property.

– Protection of the right to property is a fundamental principle of law and the owner has the right to be protected from any encroachment on his property.

3. Rights to the Property

– Apart from the right of ownership, there are also limited real rights:

– *Mortgage*: Securing a debt on real estate.

– *Right of Rent*: The right to use an immovable property for a certain period of time.

– *Possession*: Physical control and use of movable.

4. Property Disputes

– Property law can be the subject of many legal disputes such as property disputes, possession disputes, lease agreement problems.

– Such disputes are usually resolved in courts, and the parties have an obligation to provide evidence.

5. Legal Regulations

– In many countries, property law is regulated by civil or special laws. In Turkey, the Turkish Civil Code contains the basic provisions regarding the law of property.
